Attorney General’s Office Asks PSC to Vote Publicly on Data Center Power Contracts

MONTGOMERY — Aug. 27, 2026

The Alabama Attorney General’s Office is asking the state Public Service Commission to require commissioners to vote in public on whether to approve large load electric contracts — the kind of agreements that cover hyperscale data centers.

In comments submitted Aug. 6 as part of the PSC’s review of its rate procedures, Attorney General Steve Marshall wrote that “the PSC has the responsibility to protect ratepayers and there must be a procedure in place for commissioners to understand the impact of large load electric contracts on ratepayers.”

The PSC opened a public comment period this summer on how it evaluates data center contracts, including whether to extend the review window on Alabama Power filings from 10 days to 45 days. Data centers and their effect on power bills have become a leading issue in this year’s state campaigns.
