Appeals Court Upholds Capital Murder Conviction in Lee Road 188 Killing Near Waverly

The Alabama Court of Criminal Appeals has upheld the capital murder conviction of Marcus O’Keef Wigley, 40, of Lee County, Attorney General Steve Marshall’s office announced Wednesday.

A Lee County Circuit Court jury convicted Wigley on Feb. 12, 2026, and he was sentenced to life in prison without parole. According to the attorney general’s office, evidence at trial showed that Thomas Green was abducted from a party by several people who apparently believed he had stolen something of theirs. Green’s body was found several days later along Lee Road 188 near Waverly. He had been shot many times.

Investigators used eyewitness testimony, cellphone analysis and footage from numerous surveillance cameras to trace the killers’ movements that night, the office said. Lee County District Attorney Jessica Ventiere prosecuted the case. The appeals court issued its decision on Sept. 18. Assistant Attorney General Riggs Walker handled the state’s side of the appeal.
